Image

The judge, Maureen Onyetenu, in her ruling ordered Mr Akindele to be remanded in Ilesa prison custody until December 17. Mrs Onyetenu ordered the prosecution counsel from the ICPC to produce video evidence of the lecturer and his student ”having fun”. Earlier, ICPC Senior Legal Officer, Kehinde Adetoye had prayed the court to deny the defendant bail on grounds that he will not appear for his trial when released. Mr Adetoye argued that the defendant had refused to appear in their office in Abuja after a written agreement to honour any invitation extended to him particularly since his return from abroad after a medical trip. Defence counsel, Francis Omotosho, prayed the court to grant his client bail pending the final determination of the case. The lecturer was first arraigned on November 19 by...

Opinion: Immunity Clause under the Nigerian Constitution: Matters Arising by Binzak Azeez

Image
The doctrine of sovereign immunity is of immemorial antiquity. The exact origin of the concept has been a nebulous long-term debate. Nevertheless, it is a prominent purview among the legal historians that sovereign immunity stemmed from the English common law system. This anachronous principle is established on rex non potest peccare maxim (the king can do no king). The body solely responsible for law-making and adjudication was the king or his representatives. The king was the most superior being and therefore exempted from legal proceedings, obligations and liability which might occur while discharging some onuses singlehandedly or by proxy. Nigeria is a creation of the 1914 Constitution fashioned out by Lord Frederick Lugard, a British imperialist. Prior to the colonial arrangement of the fragmented territories that sum up Nigeria, each territory had its distinct unwritten constitution. English Law (common law) was incorporated into the Nigeria's political sphere alongside the t...

Image
Peter Oyebanji Well, it's no news that the Academic Staff Union of Universities (ASUU) is currently on strike, they are on strike based on the 2009 agreement they signed with the federal government. The agreement which ASUU claimed was enter into because they really love the educational sector and they want to revitalize it. The educational sector loves you too ASUU, keep doing what you're doing! As Nigerian students in various universities are currently enjoying the strike which is one of the silver linings in attending universities nowadays, I mean that joy of seeing NASU or ASUU pursuing you with sticks, sweet something. It is unfair that OAU students can't relate right now, strike is a welcoming something by Nigerian students, especially when you are in a hell like OAU. Although, OAU students aren't enjoying the strike but they're having fun too. It is just that they are relying on the referee not to mind the weather. For clarification purpose, OAU ASUU is curre...
